Analisis Sosiologis Terhadap Efektivitas Sanksi Hukum Dalam Mengurangi Tindak Pidana Korupsi

Penelitian ini bertujuan untuk menganalisis efektivitas sanksi hukum dalam mengurangi tindak pidana korupsi di Indonesia melalui pendekatan sosiologi hukum. Penelitian terdahulu umumnya berfokus pada aspek normatif peraturan perundang-undangan, sehingga belum mampu menjelaskan secara komprehensif kesenjangan antara kekuatan hukum secara formal dan realitas praktik di lapangan. Oleh karena itu, penelitian ini mengisi gap tersebut dengan menekankan analisis pada budaya hukum dan kesadaran hukum masyarakat sebagai faktor penentu efektivitas sanksi. Metode yang digunakan adalah kajian kepustakaan dengan pendekatan yuridis normatif yang diperkaya perspektif sosiologis. Hasil penelitian menunjukkan bahwa sanksi hukum di Indonesia secara normatif telah memadai, namun belum efektif secara sosiologis akibat lemahnya implementasi deterrence theory, budaya hukum yang permisif, serta rendahnya kesadaran hukum. Selain itu, inkonsistensi penegakan hukum dan relatif ringannya vonis turut melemahkan efek jera. Implikasi penelitian ini menegaskan pentingnya pendekatan multidimensional yang tidak hanya berfokus pada pengetatan sanksi, tetapi juga pada reformasi budaya hukum, penguatan kelembagaan, dan peningkatan kesadaran hukum masyarakat guna menciptakan strategi pemberantasan korupsi yang lebih efektif dan berkelanjutan.
